Terms of Service
Last updated: October 23, 2026
These Terms are an agreement between you and Kagelot, Inc., a Delaware corporation ("Kagelot", "we", "us"), about your use of kagelot.com, the Kagelot app, its MCP connection and related services (the "Service"). By creating an account or using the Service you agree to these Terms. If you use Kagelot for a company, you confirm you may bind that company.
1. Who can use Kagelot
You must be at least 18, or the age of majority where you live, and able to make a binding contract. One person per account; keep your password and MCP keys secret. You are responsible for everything done through your account and keys.
2. What Kagelot does
Kagelot is an AI filmmaking workspace: you write and direct with an AI assistant, and generate images, video and other media through third-party AI models. Results come from those models; we don't guarantee any particular result or quality, or that a generation will succeed.
3. Plans, credits and payment
- New beta access is a one-time €69 payment for 30 days, including €50 in production credits. It does not renew automatically. Payments are processed by Stripe; we do not store card details. Applicable taxes are included in the displayed beta price. Existing monthly or yearly subscriptions continue under their purchased terms until cancelled.
- Credits pay for media generation (images, video, renders, MCP tools). Credit costs are listed on the pricing page and shown in the app before you generate. Credits have no cash value, can't be transferred, sold or exchanged for money, and aren't a deposit or e-money.
- Included beta credits expire when the 30-day access period ends and do not carry over. A new payment starts a new period with a new allowance. Selected test partners may instead receive a single seven-day trial with a limited allowance; its unused credits expire when that trial ends.
- New signups do not receive automatic production credits. Director chat has a separate included usage limit; production top-ups do not increase that limit.
- Purchased credit packs are used after included credits and do not expire while your account is open. An active beta period or existing subscription is required to use them; unused purchased credits remain available for future paid access periods.
- Credits are charged only when a generation succeeds. A generation that fails or that you cancel costs nothing. A generation that completes but that you don't like is charged.
- We may change prices or credit costs with at least 30 days' notice for subscriptions; changes apply from your next billing period. The credit cost shown when you confirm an action is final for that action.
- You can cancel any time in Settings; you keep access until the end of the paid period. See the Refund Policy.
4. Your content
- You own what you put in and what you make. "Your Content" means your prompts, scripts, uploads, and the images, videos and files generated for you, to the extent the law and the model provider allow ownership of AI output.
- You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display Your Content only to run the Service for you (for example: sending a prompt to a model, storing a render, showing a project to the team members and link holders you chose). This licence ends when you delete the content or your account, except for backups kept for a limited time and anything you shared with others.
- We don't use Your Content to train AI models. The AI providers we use process it under their API terms (see the Privacy Policy).
- We won't show Your Content publicly (for example on our homepage or showcase) without your permission.
- You are responsible for having the rights to everything you upload or ask the AI to use, including images of real people, voices, logos, characters and other people's work.
5. AI output
AI output can be wrong, offensive, similar to other people's work, or similar to what other users receive. Check it before you publish or rely on it, especially facts, names, quotes and anything legal, medical or financial. Similar output given to another user isn't Your Content.
6. Acceptable use
You must follow the Acceptable Use Policy. We may remove content, refuse a generation, or suspend accounts that break it.
7. Teams and sharing
If you invite people to a project, they can see and edit its files, canvas and AI chat. If you create a share link for a file, anyone with the link can view that file. You are responsible for whom you share with; you can turn links off and remove members any time.
8. Third-party services
The Service sends data to AI and infrastructure providers (listed in the Privacy Policy) to work. Their availability, limits and rules are outside our control; if a provider stops a model, we may replace or remove it.
9. Our property
The Kagelot software, design, brand, built-in styles and themes, prompts, agents and documentation belong to us or our licensors. You may use them only inside the Service. Open-source parts are under their own licences (see Open-Source Licences). You may not copy, resell or reverse-engineer the Service, scrape it, or use it to build a competing product.
10. Suspension and ending
You can delete your account any time. We may suspend or end your access if you break these Terms, don't pay, put the Service or others at risk, or if required by law. If we end a paid plan without cause, we'll refund the unused part of the prepaid period. After deletion we delete Your Content within 30 days, except backups and what the law requires us to keep.
11. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose, non-infringement and uninterrupted or error-free operation.
12. Limit of liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, lost profits, lost data or lost revenue. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing here limits liability that can't be limited by law.
13. Indemnity
You'll cover our reasonable costs from claims by others caused by Your Content or your breach of these Terms or the law.
14. Changes
We may update these Terms. For material changes we'll notify you by email or in the app at least 14 days before they apply. Using the Service after that means you accept them.
15. Law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim there. Before any formal claim, contact us at support@kagelot.com and we'll try to resolve it within 30 days.
